This Privacy Policy (the " Privacy Policy ") sets out our approach to the processing of your personal data that we collect and the purposes of such processing. It also describes your rights with respect to our processing of your personal data.

2. WHO ARE WE, WHAT DO WE DO?

The A3TS is an association under the French law of 1901, dedicated to the dissemination of materials processing techniques - heat treatment and surface treatment - in the industrial sectors: heat treatments, thermochemical treatments, thermal spraying, wet process surface treatments, dry process surface treatments, thin film coatings.

The actions of A3TS: organization of conferences and technical days, exhibitions and fairs, organization of specialized training, dissemination of scientific and technical information databases, participation in standardization committees, networking, national and international.

We may collect your personal data either in the context of requests for information that you may send us or for the performance of our Services.

  • Relevant information required by "Know Your Client" or anti-money laundering regulations and in the context of new client intake procedures. This may include evidence of the source of funds, at the beginning of the relationship and sometimes on a regular basis throughout our relationship with clients, which information may be requested and/or obtained from third parties. Sources of verification may include documentation we request from prospects and/or through the use of online sources;

  • any other information relevant to the provision of Services.

This data is collected exclusively and directly from you.

  • provide our Services;

We may use your personal data for the following purposes:

Our Services
The data collected is processed for the purpose of providing our Services, to the exclusion of any other use. Without this data, we are not able to process your requests and to carry out the Services, if necessary.

Concerning the association directory: As soon as you join the association, your personal data will be used to appear in the A3TS online directory (members' area reserved for members) and in the paper directory published each year. You accept that your personal data may be distributed by A3TS at the request of a third party.

Concerning your registration for events or the Photo Competition: When you register, you authorize the association to distribute your personal data, as communicated in the registration process, to participants in the event. This personal data (surname/first name/company) may appear in the form of a list of participants, distributed on paper or electronically. In the case of the photo contest, they appear in the context of the selection of photos by the members of the jury, then in the context of the presentation of the results.

Business management and compliance with the law
For legitimate business purposes, we also use your personal data for the purposes of our business and compliance with the law:

  • compliance with our legal obligations (including to any regulatory authority or regulatory body having jurisdiction over the provision of legal services, know-your-client or anti-money laundering obligations, conflict of interest obligations or similar obligations, but not limited to maintaining mandatory insurance);

  • assert our rights in court;

  • protect the rights of third parties; and

  • as part of a business transaction, such as a merger, restructuring or divestiture.

6. WITH WHOM WE SHARE YOUR PERSONAL DATA

In addition to the cases provided for in article 5 above, we may communicate your personal data under the conditions described below, when necessary and, where applicable, with your prior consent:

  • To defend our rights: this may include our professional advisors, such as lawyers and accountants; public or regulatory authorities; insurance companies providing professional liability insurance coverage; regulatory bodies/tax authorities/company registries;

  • For the realization of complementary services, in particular our partners with whom we outsource certain services, including, in particular, providers of computer systems or software editors, providers of postal mail or private messaging who help us to deliver our prospecting campaigns by mail, or to give you documents relating to a file.

Apart from these cases, A3TS does not communicate your data. A3TS does not transfer your data either for commercial purposes or for any other use.

If there are special circumstances that require us to share your personal data with other parties in order to provide the Services in the most efficient manner, we will seek your prior consent.

We have obtained the appropriate guarantees from all our service providers and subcontractors with regard to personal data.

7. OUR USE OF COOKIES AND OTHER TRACKING DEVICES

8. TRANSFER OF YOUR DATA

A3TS does not transfer any of your data to anyone other than its provider Squarespace.

Indeed, A3TS uses the Squarespace platform to host and maintain its website. Squarespace makes every effort to comply with the legal obligations applicable to the protection of personal data.

It is PrivacyShield certified. This is a self-certification mechanism for companies established in the United States. The Privacy Shield has been recognized by the European Commission as providing an adequate level of protection for personal data transferred to the United States. 9. HOW LONG YOUR PERSONAL DATA WILL BE KEPT

With respect to visitors to the Site, we will retain personal data for three years from the date of our last interaction with you and in accordance with our obligations under the EU General Data Protection Regulation or any equivalent law applicable elsewhere in the world, or for longer periods if we are required to do so pursuant to our regulatory or professional liability obligations.

In relation to the provision of Services to a client, we will retain personal data for the duration of the contractual relationship and for at least six years from the date of our last interaction with the client and in accordance with our obligations under the EU General Data Protection Regulation or equivalent law applicable elsewhere in the world or for longer periods if we are required to do so in accordance with our regulatory obligations or our professional indemnity obligations. We may then destroy such files without notice and without incurring any liability.

We may delete personal data that is only used in the short term, for example for specific marketing campaigns.

10. CONFIDENTIALITY AND SECURITY OF YOUR PERSONAL DATA

We are committed to ensuring the security of personal data provided to us and have implemented information systems security policies and appropriate technical measures to protect personal data under our control from unauthorized access, alteration, use, disclosure or unlawful destruction or accidental loss.

All our partners and data processors (i.e. persons who process your personal data on our behalf for the above-mentioned purposes), who have access to and are involved in the processing of your personal data, are obliged to respect the confidentiality of such data.

We may make periodic changes to this Privacy Policy, including to reflect any changes in our data processing policy and/or to comply with changes in applicable laws and regulations.
